1. Acceptance of Terms

By accessing umbrellahive.org or purchasing any product or service from Umbrella Hive ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use our website or services.

2. Services Description

Umbrella Hive provides digital products (guides, templates) and AI automation services (scheduling systems, follow-up automation, review management) for businesses. All services are provided on an "as-is" and "as-available" basis.

3. No Guarantees of Results

We do not guarantee any specific outcomes, revenue increases, time savings, or business results. Any case studies, testimonials, or examples referenced in our marketing materials represent individual experiences and are not promises of typical results. Your results may vary based on your specific circumstances, market conditions, implementation, and other factors outside our control.

4. Digital Products

Digital products (PDFs, guides, templates) are provided for educational and informational purposes only. They do not constitute professional, medical, legal, financial, or insurance advice. You should consult qualified professionals before making decisions based on information in our products.

All sales of digital products are final. Due to the nature of digital goods, refunds are provided at our sole discretion.

5. Automation Services

For automation services (monthly retainer plans):

• Services are provided as described in the scope agreed upon at onboarding.
• We are not responsible for third-party service outages (Twilio, email providers, hosting platforms, etc.).
• We do not guarantee 100% uptime. Reasonable efforts are made to maintain service availability.
• Either party may cancel with 30 days written notice. No refunds for partial months.
• Client is responsible for ensuring their use of automation complies with applicable laws (TCPA, CAN-SPAM, state regulations).

6. Limitation of Liability

To the maximum extent permitted by applicable law, Umbrella Hive and its operators, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use our services or products;
• Any unauthorized access to or use of our servers and/or any personal information stored therein;
• Any errors, inaccuracies, or omissions in our content;
• Any third-party actions or services;
• Business decisions made based on our products or services.

Our total liability for any claim arising from these terms or our services shall not exceed the amount you paid us in the 3 months preceding the claim.

7. Indemnification

You agree to indemnify and hold harmless Umbrella Hive and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our services, your violation of these terms, or your violation of any applicable law.

8. Intellectual Property

All content, products, and materials provided by Umbrella Hive are protected by copyright. You may not redistribute, resell, or share purchased products without written permission.

9. Governing Law

These terms shall be governed by the laws of the State of Indiana, United States, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

10. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the new terms.
